RE-APPLICATIONS.
The Clerk of the Bench placed before the Li-
censing Magistrates the petition of Mr Charles
Kiernan, landlord of the Royal Exchange Hotel,
Market-square, soliciting that the license re-
fused to him at the last General Meeting might
now be re-considered.
Mr Harwood, on behalf of the applicant, sup-
ported the prayer of the petition. He urged
before the Bench, the harshness of the decision
which, for one offence, punished the man by
inflicting a fine of £20, and subsequently, on
the alleged demerits of the same, refusing the
man, by depriving him of his license, of the
means of supporting himself and family. Mr
Harwood also submitted that his client was in
firm, and had been partially deprived of his eye
sight, and contended that under such afflictions
it would be more cruel than just to deprive Kier-
nan of his license.
The Chairman enquired of the senior Serjeant
of Police, as to the general character of the pe-
titioner, and was answered in favourable
terms.
Mr Strachan wished to know if Kiernan had
since been brought before the Bench for a
breach of the Licensing Act, and was answered
in the negative.
The Mayor observed, that he would be no
party to the granting of the license on this oc-
casion.
Mr Strachan said, that nothing had been pro-
duced before the Court to show that Kiernan had
forfeited his license, by infringing the Licensing
Laws, and he should, consequently, move its
being granted.
The majority being in favour of Kiernan, the
late license was ordered to be renewed.
Mr Daniel Hurley, and Mr William Ross,
also appeared before the Court, to support the
tenor of the petition for the renewal of their re-
spective licenses, which, being well supported
by Mr Harwood, the Bench decided upon re-
voking their late decision, and granted the
same.
Mr. Thomas Puflett, of the Bush Inn,
Corio-street, who had also been deprived of his
license at the last General Sessions, made a re-
application for the same, through the advocacy
of Mr. Robert Garratt, the solicitor, but was
unable to alter the late decision ; and the order
for its refusal was confirmed.
Mr. Harwood then applied for a re-hearing
of the application of Mr. Neville, of the Bri-
tannia Inn, Yarra-street, whom he alleged had
been deprived of his license through the recom-
mendation of Mr. Justice Pohlman, on account
of a robbery having been committed upon the
premises.
The present application of Mr. Neville's not
being supported by petition, the Bench recom-
mended that method to be pursued if he was
anxious of success.
After a short deliberation, the Mayor said,
upon Mr. Neville coming before the Bench,
that under all the circumstances of the case,
the renewal of his license would be granted,
? at upon the hope that no occurrence of a
similar nature would ever take place upon his
premises in future.
Mr. Doyle, on behalf of John Broderick,
applied for the re-consideration of his applica-
tion for a license. After a short deliberation,
the application was again refused.
