enlisted for four years, deserted soon after
joining his Corps, hut gavo himself np she
months afterwards. Brought before a court
martial, ho was ou tho point of being convicted
when hi» counsel rnUed a polut of law. Ho
urgi'otl that his client, who had deserted, ha l no
right to be a soldier, and that no ofTence could
therefore oxlst. The court-martial suspended
judgment, pending til« argument of tho tegul
point before tho Civil Court.
