INSOLVENCY
ADELAIDE: Friday, October IS.
(Before Mr. Commissioner Mitchell.)
In the matter of Victor Heithereay wurm,
of Adelaide, auctioneer; adjourned final hear
ing:. Mr- O. F. Michell appeared for the offi
cial receiver aud opposing creditor. .The
Bearing -was sojourned ior a lonnigni.
In the matter of Horace Norman Phillips,
of Freeling, labourer, previously ? of Gawler
and Peterborough, fruiterer; final hearing. Mr.
M. Badger appeared for the umolYtnt, tnd
Mr. E. A. Genden for the opposing creditor.
The accountant reported:— Liabilities, £706
19/1; assets, nil. The insolvent started ' a
fruiterer's business in Gawler in January, 1921,
and, after having been there for three months,
opened a business at Peterborough, where he
remained until December of that year. He
attributed his present position to want of capi
tal and the scarcity of fruit and vegetables
during the year, which resulted in heary losses
to him. The hearing was adjourned for three
weeks to enable the insolvent to be examined
in Chambers.
In the matter . of Samuel Thomas Phillips,
of Hamley Bridge, fruiterer, formerly of Gaw
ler and Wallaroo;, final hearing. Mr. M. Bad
ger appeared for the insolvent, and Mr. E. A.
Gendere for. the opposing creditor. ' .The in
solvent was the father of the man whose case
was' the previous one before the Court. The
accountant reported, liabilities (a&niUed
£83 9/G (disputed) £245 3/4; total '£678
12/10; assets, £100; deficiency in estate,
£478 12/10. In 'November, 1919, the Insol
vent made an offer to his then creditors of
8/ in the pound, in full satisfaction, of ..his
debts. That -was accepted, and he handed
Dver £150 for distribution. The ram of only
0/ in the pound had been' paid. ' In 1919 he
started business at Wallaroo, but was forced
to sell out a few months afterwards. . He j
then opened a shop in Moonta, and subsequently
at Eapunda and then Gawler. The .insolvent
attributed his present position to want of capi
tal, to having been unable to 'satisfy the pay
ments becoming due under the composition made
In 1919, and to further liabilities contracted
in his business affairs since 1919. The hear
ing was adjourned for three weeks, the insol
vent to be examined in Chambers in the mean
time.
