DOINGS ON BOARD THE GOLDEN LAND.
At the Sandridge police court, on Thursday,
the 8th instant, Frederick Marshall, seaman,
belonging to the Golden Land, a Government
immigrant ship, was charged with assault
ing his chief officer. On 29th July, the prisoner
was on the quarter-deck, talking to one of the female
passengers, when the chief officer, who had repeatedly
told him not to talk to any of them, ordered
him away. The prisoner then walked towards the
officer in a threatening manner, and refused to obey
the order. The officer pushed him forwards, and
the prisoner struok the officer in the face with his
fist. On the same day the prisoner was seen aft
again, and ordered away by the officer, when he
threw the officer on a spar and cut his face. Since
then he has several times disobeyed orders and
persisted in talking to the female passengers.
He was sentenced to eight weeks, with hard
labor, on board the hulks. — The emigration
officer, summoned John Pendy, chief officer of
the Government immigrant ship Golden Land, for a
breach of the 60th section of the Passengers
Act, which prohibits all immoral or indecent
acts or conduct, taking liberties, or using
improper familiarity with the female passengers.
Samuel Smith, seaman, John Elms, second steward,
and William Patterson, , second mate, were
examined, and from their statements it
appeared that, on the evening of the 17th August,
about half-past twelve o'clock, the defendant was
seen leaving his own cabin and going into another
cabin occupied by two female passengers, where he
remained until a little after three o'clock; that
while he was in that cabin, one of the
females was heard to say, "If you have
any respect for me, desist," and he was heard to say,
'It's no — — use, I'm stronger than you." Mr
Read, for the defendant, impeached the testimony
of the three witnesses as utterly untrustworthy; asserted
that the story was trumped up after the second
mate had been discharged from the ship on a
complaint made by the chief mate of neglect of
duty, and contended that, if the story were true,
the captain and medical officer ought to have been
informed of it at once; and that the two females ought
to have been brought forward to give their evidence.
Mr Call had no hesitation in saying that there was
sufficient evidence to prove a breach of the Passenger
Act; and imposed a fine of 40s, with fourteen
days in gaol. Mr Read appealed, and deposited £20
as security.
