BEACH EPISODE.
Crown Case Fails.
A plea of not guilty was entered by
Thomas Henry Nelson, an elderly man,
when charged before Idr. Justice Wolff
and a jury in the Criminal Court yes
terday with having unlawfully and in
decently assaulted a 19-year-old girl, at
Leighton on November 28 last. The
Crown Prosecutor (Mr. S. H. Good) con
ducted the prosecution, and Mr. F. G.
Unmack appeared for the defence.
The Crown case was that while the
girl involved in the case was lying on
the beach in her bathing-dress, at Leigh
ton on the afternoon of November 28,
quietly reading a book, she was ap
proached by the accused. He jumped down
beside her and made advances which she
indignantly repulsed, and which led to a
violent struggle, in the course of which
the girl scratched the man's face and
herself received injuries to her back,
through contact with rocks. One of her
knees, also, was injured in the struggle.
For the defence it was averred that
the girl was naked on the occasion in
question, and that the accused, whose
curiosity was aroused, was approaching
her 'when she suddenly assaulted him.
He, and not she, was the victim, he
maintained; he emphatically denied that
he had assaulted the girL
The jury, after a retirement of lhr.
45min., brought in a verdict of not
guilty.
