Assault on Bailiff Alleged
A charge of having assaulted Ed-
ward Leonard Nenke, assistant bailiff,
of the Adelaide Local Court, while in
the execution of his duty on May 26,
was denied by Francis Iles Swan, can-
vasser, of Farnham-road. Ashford, be-
fore Mr. K. F. V. Sanderson, SM.. in
the Adelaide Police Court yesterday.
Mr. D. L Richards, of the Crown
Law Offlce, appeared for the complain
ant (Walter Henry Howell, of the
Adelaide Local Court), and Mr. J. W.
Nelligan, represented Swan.
Nenke said that he went to the
office of Bungalow Products, Limited,
A.N.A. Building, Flinders-street, on
May 26. to serve two unsatisfied judg-
ment summonses on Swan. He asked
a boy at the office if Mr. Swan was
in. and the boy told him that Swan
was out. He went through a door in
the counter, and when he reached the
door of the inner office he was struck
on the head with a piece of wood held
by Swan, who called out, "You are
trespassing." Nenke then handed two
unsatisfied judgment summonses to
Swan, who refused to take them. He
left them on a table, and returned
later with Constable Lawton. but Swan
had gone.
Constable Lionel D. Lawton said be
saw Nenke in a dazed condition with
a bruise across his forehead. He said
a man had hit him with a stick. He
went to the office of Bungalow Pro-
ducts. Limited, with Nenke. and saw
a dark colored stick about 3 ft. long.
Swan on oath, said he was in his
brother's office in the A.N.A. Build-
ings, when he heard a man entering
the outer office, and asked a man
named Francis to look through a hole
In a partition. Francis called out,
"Look out. there's a guy with a gun."
He grasped a coat hanger from a hook
and make a stroke at the intruder's
arm to knock the gun down. The in-
truder immediately left the office, and
he went to look for him. When he
returned to the office he found Nenke
and Constable Lawton waiting for
him.
The hearing was adjourned.
