WASHINGTON, Tuesday.— The
Supreme Court has granted a stay
in the execution of General Tomo-
yuki Yamashita, sentenced to death
as a war criminal.
A U.S. Military Commission in
Manila found Yamashita, for
merly commander of Japanese forces
in the Philippines, guilty of atroci
ties against Allied troops.
He appealed on the ground that
the tribunal had no jurisdiction,
and asked to be taken to Wash
ington to appeal' to a civil court.
Ever since Yamashita was sen
tenced on December 7 long queues
of people in Tokio have signed a pe
tition to General MacArthur be
seeching him to reprieve Yamashita.
An International News Service
message from Manila says that
Yamashita, if still alive, will be
called as a star witness in the de
fence of General Masahura Homma,
"Beast of Bataan," who is to face a
war crimes tribunal there.

from Yokohama says preliminaries
for the first war crimes trial in Japan
began yesterday, when a nine-man
military commission met to decide
procedure in the trial of Tatsuo
("Little Glass Eye") Tsuchiya, guard
at Mitsushima camp, on charges of
mistreating U.S. prisoners.
