£1,310 AWARDED FOR
LOSS OF LEG
AN award of £1,310 was made by the Chief justice
(Sir john Morris) in the Supreme Court at Ho-
ebart yesterday to an employee of the Pioneer Wood
ware Co. Pty. Ltd.
The plaintiff was Edward
Wyndham Webb (64), of New
Norfolk.
Mr. J. B. Piggott (for the
plaintiff) said Webb was em-
ployed as a boiler attendant in
the furnace room of the çom-
pany's peg factory at New Nor-
folk.
He fell when he slipped on a
peg while attending to a boiler
tap on December 19,1952. Gan-
grene developed in the right
leg, which was amputated.
Medical evidence by Dr. D.
Parker, orthopaedic surgeon at
the Royal Hobart Hospital, was
that Webb had been suffering
from arterio-sclerosis, or nar-
rowing of the arteries, of the
right leg for 12 months before
the accident, and that without
any accident it was probable
Webb might have had three to
four years' use of the diseased
limb.
The accident, which had
caused acute bending of the
knee and bruised the main ar-
tery behind the knee joint, ac-
celerated the onset of gangrene.
Mr. Piggott contended that in
those circumstances Webb was
entitled to compensation. The
accident had contributed to ul-
timate amputation of the limb,
and the pre-existing disease was
not wholly responsible.
The Chief Justice ordered the
company to pay costs of the
action.
