THE MERCANTILE BANK CASE.
PERSECUTIONS NEARLY CLOSED.
Melbourne, February 27.
The Mercantile Bank prosecutions have
nractically closed. Mr. Ducker to-day
was not prepared for the continuation of
the cross-examination of Mr. Ainsley.
The judge refused to admit as evidence a
statement of the position of the bank
made out at Mr. Miliidge's instructions,
and a statement made soon afterwards
when reconstruction was proposed. He
refused to allow such comparison to be
proved, because it had been urged that
the stoppage affected the values, and the
community was in an electrical state.
Mr. Walsh asked the judge to state a
case to the Full Court, but his application
was refused.
Mr. Walsh, in the course of the pro
ceedings, said the prosecution was not
able to prove the knowledge of the defen
dants of the bad debts in the February
balance-sheet, and he would therefore
withdraw all evidence referring to that
part of the case.
