Cooper, sued for JJ10, damages done to a.
.quarry. Verdict for plaintiff for £7.— In
the case T. D. Heazlewood v. M. M. Knox,,
it appears that on July 16, 1838, defendant,
purchased an allotment of land in the town
ship of Heazleton for £40, haring six years
to pay purchase money, and also agreed to
pay interest on same at 8 per cent. per
annum, and because it did not state
specifically that the interest was to be paid
yearly, defendant repudiated payment of
interest until the six years were up. How-,
ever, the jury — Messrs D. H. Johnstone, F.:
Reeve, and F. Palmer— took a common
sense business view of the matter, and gave
a verdict against defendant for full
amount.
