TOWN COURT.
Monday , 20th December.

DRUNKENESS—Two persons were dealt with.
Attempt to Steal.—Ham Quong was charged with
having attempted to steal a sixpence and two three
penny pieces from the till in the shop of John Broom-
field. Mr O’Dee defended the prisoner. Susan Broom-
field deposed that on last Thursday evening she saw
the prisoner in her husband’s shop. The prisoner put
his hand over the counter; and unlocked the till,
which contained a few coppers and a couple of three
penny pieces. When she saw the prisoner put his
hand over the counter she ran into the shop, and the
prisoner attempted to get away. William Fisher, a
lad in the employ of Mr Broomfield, corroborated the
evidence of the last witness. The prisoner was sent-
tenced to seven days’ imprisonment.
Assault.— John Thomas Jacobs was charged with
having assaulted a woman named Ellen Henderson,
with whom he was living. The prosecutrix, who did
not wish to-press the charge, deposed that on Friday
morning the prisoner, who was very drunk, beat her
in a cruel manner. Senior-constable Nolan deposed
that when he saw the woman after the assault her face
was regularly battered and her body was cut about in
a shocking manner. Constable Thompson deposed
that he arrested the prisoner, who admitted, having
assaulted the woman. A piece of flesh had been
kicked off the woman’s leg by the prisoner. The pri-
soner was sentenced to two months’ imprisonment.

The application of John Bibby, for the Lancashire hotel,
Black Hill, was objected to by the police on the
grounds that the licensee was of drunken habits, that
the house had not the required accommodation, that
the house, was not required, and that it was badly
conducted. Sergeant McFarland deposed that he had
only been in Ballarat three months, and during that
period he had frequently seen the applicant drunk
when behind the bar. Constables Goan and Par
sons, who had known the applicant for many
years, deposed that they had often seen him drunk
behind the bar; the license was refused on the ground
that the applicant was of drunken habits, the other
objections not being heard. The application of James
Grotty, for the Junction hotel, Peel street, was ob-
jected to by Serjeant McFarland, on the ground that
the house had not the required accommodation, that
there was very little furniture, and of an inferior
quality,' in it, and that there was no stable; the license
was refused.. The application of Alfred S. Brown for
the Prince of Wales hotel, Humffray street, was objected
to by Sergeant McFarland, on the grounds that
there-was not the required accommodation, that the
house was in a. bad state of repair, and that there
was very little furniture in it; the license was refused.
Cause List. —Sergeant Laner v M.O’Loughlin,
unclean premises; fined 20s and 5s costs. H. Bloom
field v Bernard Ahern, no name on dray; fined Is and
10s costs. Thos. Russ v Timothy Ryan, assault; Mr
Wynne for the' complainant. The assault was the
outcome of a dispute about the payment of toll at the
Victoria street gate. Fined 20s and 21s costs.
The court then adjourned.
Learmonth.—Monday, 20th December, before Mr
G. G. Morton, J.P.—Henry Coles was charged by
Police-constable Marston, of Burrumbeet, with lunacy,
through drink. The prisoner, who had recovered his
senses, was discharged. The court then adjourned.
Smythesdale.—Monday, 20th December, before Mr
B. Smith, P.M.—Constable Daly v Thomas Adams,
prisoner was charged with being drunk and disorderly;
fined 0s or twelve hours’ imprisonment. Constable
Daly v Thomas Adams, prisoner was charged with
making use'of, obscene language in a public place at
Haddon; fined ss, or in default twenty-four hours’im
prisonment. ■ Constable Daly v Thomas Adams, prisoner
was charged with threatening behavior in a public
place .at Haddon; fined-10s, or in default three days’
Imprisonment, ‘to be cumulative on' former sentences.
The fines in each case were paid. Benjamin Trever
ton was charged with fighting at Haddon; fined 2s 6d
and 6a costs.
