DISTRICT COUNCIL OF
ENCOUNTER BAY
Minutes of Monthly Meeting
Present: The Chairman (Cr.
A. G. Siegert), Councillors H. L.
Smith. O. B. Hutchinson, L. F.
James, H. R. Sweetman, R. F.
Stephetis. ,md the district clerk.
The Chairman opened the
meeting and introduced and wel
comed Mr. Fowler, who has re
cently taken over the duties of
Highways Engineer for this dis
trict. In replying, Mr. Fowler
stated that he was very pleased
to have the opportunity ot meet
ing members of the Council. He
gave a brief outline of the work
ings of the Department regard
ing allocation of grants, and
stated that he wished to fami
liarise himself with the district as
soon he possibly could.
Members of the Council asked
Mr. Fowler various questions re
garding roads and grants to
which replies were given.
Chairman’* Report
The Chairman reported that on
Thursday, 7tlt January, he had
accompanied tHe clerk and Mr.
Fowler on an inspection of the
Waitpinga and Range Roads. Re
commendations were made re
garding the improvement and
maintenance of these roads.
He had bad a request from the
Ranger for the pound to be com
pleted m accordance with the
requirements of the Impounding
Act.
During a recent visit to the
cemetery with Cr. Smith, it was
decided that the western end of
tin- cemetery should be cleared to
allow tor more graves. Lavatory
•ico amiodation at tHe cemetery
should he treated as urgent.
Complaints have been received
regarding the piggery which is
situated adjacent the cemetery.
Regarding the Council’s ap
proach to the Victor Harbour
( orporalion regarding repairs to
the wall at the Bluff Jetty, he
noticed, in the “Victor Harbour
'limes" (8/1/34). that the Cor
poration had refused any assist
ance He suggested that a letter
he forwarded to the Tourist
Bureau pointing out that the
jetty should he preserved, but
that it was beyond the means of
the ( onncil to pay half the esti
mated cost.
Clerk and Overseer’* Report
The report, reading as follows,
was received.
Work*: I hie to employees’ tak
ing their animal leave, only one
fortnight lias been worked during
ibis period. This time was spent
on tj'f re-sheeting of the first
portion of the Back Valley road.
Approximately threequarier-mile
of tins portion is vet to be done,
and. to dale, grant monies avail
able lor this road have been over
spent to llie extent of £250.
The Waitpinga. Range and
Hindmarsh V alley roads, and also
roads in the Kncomiter Bay area,
were graded prior to Christmas.
General: By-law re Parking.—
The Local Government Act docs
not give a District (. onncil power
to proclaim prohibited areas for
parking in the same manner as
it does for Municipal Councils.
It is necessary to pass a by-law
ami a draft copy lias been ob
tained for the information of the
Council.
Buatne** from Report
It was resolved that as the cost
of re-sheeting the first two miles
of the Back \ alley road will ex
ceed the estimate by £500, that
this portion lie completed and
that an application lie made for
a further grant to seal the road
for a distance of one mile from
the post office.
By-law re Parking: It was re
solved that a by-law, similar to
the draft submitted, giving the
Council the power to proclaim
prohibited areas for parking, be
adopted.
Correspondence
From the Director of Lands,
drawing the attention to the
summer period for the simultane
ous destruction of vermin and
stating that the provisions of the
Vermin Act should he strictly en
forced. The summer period is
from 15th February to 14th
Marclt in each year.
It was resolved that the usual
procedure he followed.
From the Director Emergency
Lire Services, acknowledging
copy of the minutes of the meet
ing ot the Fire Control Officers
and giving details of the action
taken regarding fire prevention
propaganda.
From the Fire Brigades
Board, acknowledging request for
an extension of the Fire Brigades
Act to certain portions of the dis
trict and advising that an inspec
tion of the areas concerned will
be made by a member of the
Board and the Chief Officer at an
early date
From K. M. Xewcll. replying to
letter regarding a roadway to his
property, and suggesting that Mr.
Jagger be approached and that
the t. ouncil sell other roads to
offset the cost of purchasing a
road through Mr. Jagger's pro
perty. Also offering to hire Mr.
Lush's tractor and plough to clear
and rough form the road.
It was resolved that Mr.
Newell be informed that the
Council is not prepared to sell
the roads mentioned; also that
Mr. Jagger has refused the sug
gestion made. The Council there
fore suggests that he make fur
ther efforts to obtain a right-of
way. if necessary, from some
other direction.
From Mrs. K. A. Kirkland,
drawing attention to the erosion
taking place in Oakham Street,
Island View, and requesting that
a narrow track be put down in
this street.
It was resolved that this work
he attended to when the gravel
ling of Franklin Parade is being
done.
From H. J. Blatchford, advis
ing that an agreement has been
made with Mrs. K. A. Hutchin
son regarding a right-of-way
through her property. Further,
he made application for permis
sion to work out his rates on the
road adjoining his property in
the Hundred of Goolwa.


It was resohe»i that Mr.
Blatcliford he granted permission (
to work out his rates on the road '
from Slade's house to the north
eastern corner of his section.
f ront Mrs, F M Fiddes, reply
ing to the Council's letter regard
ing the occupation of a garage
and stating that she did not think
she was doing wrong and request
ing that the Council withdraw the
charges made against Iter.
It ua- resolved that Mrs.

Financial Statement
Idle statement tor the period,

It was resolved that m connec
tion with the reports submitted
to last meeting of the Council
regarding breaches of the Build
ing Act, 1923-194G namely (a) F.
M. Fiddes occupying a garage
without Council consent and (b)
M. V. Graham commencing
building operations prior to sub
mitting plans and specifications
to the Council and receiving its
consent, be received, and that a
complaint he made before a
magistrate, and that Walter J.
M Sedgeley. the Building Sur
vey, .r apjHjinted by the Council,
be authorised to institute pro
ceedings in his own name for
and on behalf of the Council.
Work*
Cr. Sweetman reported that a
start had been made on the re
surfacing of roads m the Green
Hills area. Five persons have
spent three days and tlu-v have
treated approximately half a mile
of road. The balance of the
money should he spent within the
next tmirtecii days.
Cr Stephens reported that Mr.
B. C. N ew land had approached
him regarding a low piece of road
leading to Mr. Newland’s pro
perty It bad been requested
that the road be raised and that
a dram la constructed on the top
side of the toad Cl. Stephens
requested that this job he at
tended to whilst the machinery is
in Back Valley.
Cr. Hutchinson reported that
he had been approached bv the
residents of Hayhorougli F.ast
requesting that a track be made
on the eastern side of the rub
bish dump and leading to
beach. It appeared to he a job
tor tlte dozer, and he requested
that next time the machine is in
the vicinity that tlte track he
made
He bad received, ami tabled
herewith, a petition from resi
dents adjacent the rubbish dump
complaining of the indiscriminate
dumping of rubbish. The resi
dents were against the dumping
of rubbish in the ravine,
and he supported their claim
He had also received a request
for portion of the esplanade,
Hayborough Fast, to be graded.
From the plan, this road appeared
to be near the edge of the cliff,
and he suggested that an inspec
tion he made. A further request
had been received from Mr. J. T.
Williams regardmg the road in
front of his garage. To he in
spected before next meeting,
Cr. Hutchinson requested that
attention he given to the follow
ing roads at the earliest oppor
tunity: Hammond's Road. Mc-
Donald Street, Ocean View W est,
and the road from the Hind
marsh Valiev main road to the
third over the Hindmarsh River.
Cr. Smith requested that some
attention he given to Oakham
Street, Island View, to arrest the
erosion; that the main road from
the Yankalilla road to the Wait
pinga road be sheeted and that
Fell Street. Vtlki. he sheeted. It
was most important that the sea- {
wall at Vilki he repaired as soon i
as possible.
Cr. lames reported that he
had been ad i-ed tbat some gum'
rubble is required on the Mt.
Scrub road at the base of the
mount: this patch becomes very
slippery in wet weather. It was
suggested that Mr. Baker he
approached regarding the rub
bling of this section.
Cr. Siegert requested that
1 when the road from Honeyman's
( Bridge through the scrub is
■ -ealed that the scaling he carried
I in as far as the crushed stone
will permit The time was now
opportune to substitute pipes for
the sjtoon drain on the Wait
pinga road
Cr. Sweetman advised that he
had received many requests for
negotiations to he commenced re
garding the alterations to the
boundaries of Port Victor Ward.
The residents of the Green Hills
area still desire that the ward be
increased in size in the manner
which was suggested to the Coun
cil some time ago. If any altera
tion is to bo made, the matter
should hr dealt with straight
away, so that it will come into
operation on 1st July next.
After discussion it was resolved
that a special meeting be held
on Wednesday, 3rd February.
1954, to consider the proposed
alterations.
Cr. Hutchinson stated that he
had been approached by Mr. L.
Attrill. Myponga. regarding the
1 possibility of leasing a stone and
water reserve in the Hundred of


(joolwa. The Clerk to ascertain
what Mr. At trill is prepared to
pay per annum and also the
length of time the reserves
would be required.
Cr. Hutchinson reported that
the fire-places at Franklin Park
had been broken down just prior
to Christmas. The matter had
been reported to the office and
an inspection was made accom
panied by a sergeant of police.
The fire-places were repaired be
fore Christina-.
Cr. Smith asked that the agree
ment with Harbour Electricity
Coy be tabled. He had been in
formed that a charge was made
by the P.M.G’s. Department for
fire calls, and as some doubt
existed he requested that en
quiries he made.
It was resolved that Mr. L. H.
Kleinig be appointed assistant
Fire Supervisor.
