BEACH CONTROL.
A Council's Powers.
Sandringham council recently proceeded
against James Grace for erecting a stall
in the beach reserve at Beaunmris without
the council's consent, also for exposing
goods for sale without having first ob
tained a permit. For the defence the
council power to collect fees was ad
mitted, but that the council liau no
authority to remove vendors from the
reserve. In this case also no proof had
been advanced that defendant was ever
in the reserve.
Mr. Smith, P.M., gave his reserved de
cision on Thursday. The Lands department
plan showed the reserves referred to in
the regulations under the Lands Act to
be between the Beach-road and the sea.
The local city engineer had surveyed the
Beach-road in the locality, and had stated
that the stall was 15 feet on the seaward
side, of the Beach-road. The council was
a committee of managemeut, properly ap
pointed, and he regarded its regulations
as correct. This committee had the care
and management of the reserves, and it
had exercised its powers, especially as to
management. He thought defendant was
guilty of an offence. The decision was of
importance to the council and the public.
Unless there was some management things
would get into a chaotic state. Some of
the public might object to the mode of
management, but he was not concerned
with that. Defendant would be fined
20/ in each case, with £5 5/ costs. A
slay of fourteen days was granted.
