Joreph R. Senior proceeded against Henry
J. Heber for assault. There was a counter
charge of assault against Senior and the two
osases were taken separately. Pleas of "not
gilty " were made in each ease.
Joseph Senior deposed that on the 14th
inst. he was at a rile clab meet.
ing in Boully'se hotel. An argument
arose between witness and Heber over cer
tain matters, and they all went outeside. As
coon as witness got ouatside Heber ahteok him
on the nose with his fist, and afterwards got
his finger in witness's month and pulled.
To Heber: I and SBheppard were having a
converseation. I called yon a liar, but did
not say "let me get atyou." Did not ctrike
yeon nor told anyone that Iwanted to have a
goat you.
E. J. Bowling stated that he was at the
.meeting held in Soal'y's hotel on the 14th
instant. Saw a row, and heard Senior
aoenee someone of doing him out of a con
tract, and seid it was Heber who had told
him so. 'Heber denied it, and Senior called
him a liar. They went outside, and Heber
etauok Senior, who fell down. They were
both struggling together, but it was too dark
to distinguish plainly. When down Heber
put his Inger in Senior's month, and the
other hand on his throat.
To Hober: Heber gave evidence against
witness in a court case some time ago. He
did not hear Senior call Heber a liar.
A. W. North deposed that on the night of
the 14th instanthe was at a rife meeting at
Boully's hotel, when an altercation arose
between Senior and Heber. Senior called
Heber a liar.i They went oatside-Senior
first, and witness immediately after heard a
blow sftrck. Did not see any blows struck,
but saw Heber being dragged of Benior,
who was bleeding from a wound on the face.
To the Bench: Senior called Heber a liar.
H. J. Heber stated that he was at Sooully's
hotel on the night in question. Senior
called him a liar. Mr. Soully at once pioked
up the lamp and told them to go outside if
they wanted to Aght. They went outeside,
and he at once struck Senior. Senior stag
Pared, but immediately after rushed at him.
Witneess again struck him. Senior fell on
his knees and clasped witness round the legse.
Suspicious of what he was going to do,
witaess kioked him on the side of the jaw.
They wore then pulled apart.
The Mlagistrate dispensed with farther
evidenoe. remarking that Senior should not
have used the language he did, but Heber
had no right to take the law into his own
hands. The case against Senior would be
dismissed, and Haber fined 6s and Ts 4d
costs, in default 14 days' imprisonment.
The fine was paid.
Twenty.two hawkers' licenses were
