CONVICTION QUASHED
ON APPEAL
William Turner. of Port Lincoln. was
successful in an appeal in the Civil Court
today against a conviction. for assault re
corded azainst him in the Port Lincoln
Police Court on June 1. MIr. Justice
Piner. who occupied the Bench. quashed
the conviction. and allowed £5 5/ costs.
Mr. K. J. Healy (of the Crown Law De
rartment) said he could not resist-the ap
peal. There was not suffiefent evidence
of identification of Turner as the person
concerned in the chare.
Turner had been convicted by R. E.
Wenham and E. F. Derbyshires. justices,
of an nnlawful assault upon a woman at
Port Lincoln. Turner had denied the
charre. Respondent was Sut. A. R. West.
MIr. J. L. Travers represented Turner.
