be obtained at the Civil Commissariat Office,
Bourke-street west, Melbourne, or of the Assistant
Civil Commissary. Geelong.
The decision of the Government will be made
known on Friday, 19th January.

SUPPLY OE FORAGE tI GEELosaG DIs

I. All the articles reqired by this notice are to
be ofthe best quality of their several kinds.
2. The supplies for road parties and surveying
parties are to be delivered at the nearest fixed
stations to the places where the party may be em
ployed, on the requisition of the officer in
charge.
3. The supplies (not specified in the preceding
paragraphs) are to be delivered direct to the
parties or establishment entitled there-. on the
written order of the person duly authorised for the
purpose
4. The Tenders are to express the price per
ration only, and include the whole of the articles
specfied m the ration.
5. In the event ot a difference of opinion be
tween the contactor and the party receiving the
supplied. as to the quality, the same is to be
decided, in cases where the article is not of a
perishable nature, by a Board of Survey. ac
cording to the practice of the service. But, in
country districts, where a Board of Survey cannot
be conveniently assembled, the party objecting will
name one person as arbitrator, the contractor or his
agent another, and these two will (previously to
any other proceeding on their part) concur in
naming a third as umpire, who, in the event of the
arbitrators rnot agreeing in opinion, wil be called
upon for his deci-sion, which shall be tinal
i. If the Board,arbiatras, or umpire shall de
cide that the article is not of prvper quality, it
must be immediately replaced by the contractor,
failing which it will be procud by the party
requiring it, and the expe?se charged to the con
trac:tor.
7. In the event of any unnecessary delay or
failure of the contractors to supply the articles
when required, they will be otherwise procured,
and charged in like manre.
G. In cases where the article is of a perishable
nature, or from some other cause injury would be
sustaired, either by the parties to whom the
rations arc due, or to the contractor, by waiting
for a Board of Survey,. the Civil Commis?ariat
Oticer, the head of the department or officer in
charge of the party or parties for whom the rations
are to be received, shall have the power to reject
such article or articles as are obviously of inferior
quality ; it being distinctly understood that he will
be responsible to the government for so doing; and
that the contractor will have a ribht of appeal to
the Governor, althouh in the mean time he must
take back the rejected article, and supply good in
its stead, failing which it will be obtained by the
office or party requiring it, and the expense
charged to t?hcnstacor
9. A repetition of irregularity in the quantity
or quality of the supplies, or of any delay it
delivering or replacing them when required, wil
subiect the contractor, upon report ot the oftiiee
in charge of the parties or establishments, to such
mulct, not exceeding one-fourth the amount ol
his monthly account, as the Governor may direct
It will also be in the power of the Governor, upon
such repetition, to terminate the contract forth

limit the duration of the contract, by giving in
writing a notice of three full calendar months to
the opposite party, to end the contract at the ex
piration of that period, it being understood that
such notice can be given only from the lrst day of
a month, and within the period for which "the
contract is made or agreed to be made.
11. The contractor will be required to prepare
his own account, monthly or quarterly, in the
proscribed form: and, on the production thereof,
with the requisite vouchers, in a complete state,
to the Civil Commissary tnencral, or Assistant
Civil Commissary of the district, for examination,
they will be forwarded to the Audit Office, and
payment will he made through the Colonial
Treasury.
12 The value of all packages to be included in
the prices demanded.
1:3. Printed forms of tender may be obtained
from the Civil Commissary General, and a security
of t£0(1 will be rewjrired for the due fuLfilment
of the contract, No tender can be attended to
unless accompanied by a cettiticate from two
responsible parties proposed as security, stating
they are willing to become bound as securities for
the contractor accordingly, and the bonds must be
executed within twenty days from the day of
acceptance of the tender being notified, failing ot
which the contracts will be again advertised or
another tender accepted.
I1. The tenders are required to have attached to
them the sigratures of the party or parties willing
to supply the Government with the articles enume
rated, as also the names of the persons proposed as
sureties for the due fulfilmentoftheircontracts,
stating fully the addresses or residence.
15. Tenders will be received for the supplv of
the entire district or for any particular station in it.
In the latter case the name of the station as given
before must be stated in the tender.
16. The Government will no: necessarily accept
the lowest or any tender.
