Lugger Appeal
Case
JUDGMENT AGAINST
COMMONEALTH
DARWIN, Wednesday.
Giving judgment in the first
of the lugger appeal cases
involving the seizure and de
tention last year by the Com
monwealth Government of the
Takachiho Maru No. 3, Judge
Wells, in the Supreme Court
to-day, awarded the Japan
ese £2000 damages.
Judge Wells ruled that the Common
wealth Government's contention that
the waters of 13eaucaut Baj in which the
lugger was arrested were territorial
waters within the territorial limits of
thie Northern Territory was not sustain
ed.
He also ordered:
Return of the vessel to the Japan
ese owners or payment of the value
of the boat at the time of seizure
(assessed at £1076).
Delivery fourthwith to the Japanese
owners of articles seized and after
wards removed from the vessel, or
payment of their value-£S05.
Delivery and repacking of the pearl
shell on tIhe vessel as at the time of
the seizure at the Commonwealth ex
pense if the Japanese owners or
agents so require.
If the Commonwealth Government
elects to retain the pearl shell and to
pay the Japanese owners its value as
set out, the amount of damages is to
be reduced to £170D.
