?i tie Lumpers' Union, today indicated the
possibility of a test acse under the
Workers1 Compensation Act on behalf
of members of the union who ?-ubmitleu-
themselves to vaccination in connection
?with the recent quarantining of the mall
Eteamer Narkunda.
Mr. Fox said that of the 48 members
of the union who were vaccinated to
. permit of their working cargo out °*
the ship whilst in quarantine. 22 suf
fered from after affects from the oper
; ation. and one man is still nursing a
. seDtic arm.
. He recently wrote the agents of the
ship suggesting that the company- recog
nise an obligation to the men to -the ex
tent of the liability which would be in
curred in other circumstances under the
.i Workers' Compensation Act. The agents
replied that already the company had
-.-'.. : 'omnelleri by 'force majeure' to
pay the men 25s each in connection
with the vaccination and could not ac
cept any further liability.
Commenting on that decision Mr.
Pox said it was likely the union would
bring a test case to ascertain whether
the men have a claim under the Work
ers' Compensation Act. Apart from
that aspect, however, he thought the
situation reached, suggested a difficulty
in obtaining labor in the future, when
i it was desiredj to handle cargo on. a
quarantined ship.
