Lumper Sues
Cosistabie
A claim for £100 damages
was brought by lumper Stan
ley Charles Badham, of High
St., Fremantle, against Police
Constable J. B. Riley in Fre
mantle Local Court today.
Badham alleged that on
Friday, January 13, Police
Constable Riley unlawfully
assaulted him, causing bod
ily injury, and also wrong
fully arrested him, whereby
he was detained in custody
for several hours.
Riley * denied the allega
tions.
In his statement of defence
he claimed that Badham re
sisted arrest and assualted
him and he used no more
force than was reasonably
necessary to protect himself
and to effect the arrest
In evidence, Badham said
that on January 12 Police
Constable Riley pulled him up
for not having a light on his
bicycle. The next night he
approached Riley and after
some words, he »/as arrested.
Near the Federal Hotel on
the way to the police station
Riley punched him and his
glasses fell down a grating
over a cellar. In a laneway
near the police station Riley
again attacked him. He fell
to the ground and Riley knelt
on him.
Riley said: 'Are you going
to answer the charge when I
lav it in the charge room9'
He replied: 'You are the
winner, you are in front, stop
in front.'
As a result of the blows he
received his dental plate was
broken in two places and ne
visited a doctor three times.
