Muirhead, BM- on Thursday, of an
application byHerbart A. Norman, on
behalf of A. Norman & Sans, for the
return of 61 flagons of wine seized by
'certain constables' from premises oc
cupied by Herbert A. Norman, at Sturt
road, Start, on June 2.
Mr. J. W. Neman appeared tor the
appiicanti, and Mr. L. Bond, Assistant
Police Prosecutor, opposedthe appll
Mr. Nelllgan Mid A. Norman A Sons
were vignerona. Herbert A. Norman
was a member ot the firm, and lived
at Sturt-road, Start. Although the
wine had been seized by the police no
charge had been laid, and there was
no suggestion that a charge would be
laid against the owners of tbe wine
for any breach ot the law. He sub
mitted that there was no Justification
for the seizure.
Evidence was given that wine was
made at Onderdaie by the firm, which
held a storekeeper's Australian wine
license. The premises spedfled in the
license were at Underdale. All the
wine found at the residence of H. A.
Norman was there to be disposed ot to
accordance with the terms of the
license. The vineyard was the pro
perty of the firm. The seized wine
was all ordered, and was to be de
livered by a A. Norman.
sergeant Lyons, called by Mr. Bond,
said he saw H. A. Norman leave a
motor car at about 8 pjn. on the night
the wine was seized, and go to a house
at SeacUff. In company with con
stable Shipway he went to the back
door of the house and heard Norman
say, 'I have brought the wine you or
dered.' A woman who answered said,
-i ma not oraer any wine.' Norman
said, 'This is the wine you rang up
for,' and the woman replied, 'I did I
not ring up for any wine.'' One of the
officers asked Norman what he had In
a basket and he replied, 'Wine.' The
witness took possession of the basket,
which contained two flagons of wine.
Later they went to H. A. Norman's re
sidence and took possession of 59 flagons
of wine.
The hearing was adjourned till Tues
day.
