plaintiff was not entitled to recover in respect of
the claim on the ground that the defendant ins
discharged from pavment by virtue -of the Insol
vent Act, his creditors having on December 1,
1899, passed a resolution to accept a composition
of 10/ in tiie pound. Defendant alleged that
