BURTUNDY
HOTEL.
Change Of Site
Granted.
Two applications for the transfer
of hotels in the Wentworth district
came before Mr. Bevers, S.M., on
Tuesday and Wednesday. After hear-
ing evidence and legal argument the
magistrate nodded in favor of the
transfer of the Burtundy Hotel
licence to near the Mildura bridge on
the New South Wales side, but the
application to transfer the Ellerslie
Hotel to Dareton was temporarily
withdrawn, as certain formalities
were not followed.
The first case taken was that in
which an application was made to
transfer the licence of the Ellerslie
Hotel from its present site on the
Darling River to Dareton, on the
Murray River.
Mr. Hilyard, of Mildura, appeared
for the applicant. An objection was
lodged by the district licensing in-
spector (Sergeant Ross), Superinten-
dent Winter appeared for the Police
Department.
When the case was called
Superintendent Winter contended
that all formalities required by the
Liquor Act had not been complied
with in that it was not shown in the
application that it was intended to
build a hotel. Also the required
notice had not been posted on the
land for the stipulated time. He said
that the notice was not posted when
he visited the site on October 7 and 8.
A conference of the parties was
arranged, and finally the application
was withdrawn without evidence
being taken. It will be brought on
at a later date.
BURTUNDY HOTEL CASE.
In the application for the removal
of the licence ot the Burtundy Hotel
to near the Mildura bridge on the
New South Wales side, Mr. J. J.
Davoren, of Broken Hill, instructed
by Mr. Cogswell, of Mildura, appeared
for the hotelkeeper and Superinten-
dent Winter for the police authori-
ties, the district licensing inspector
(Sergeant Ross), having lodged an
objection. The proprietor of the
Gol Gol Hotel also objected, being
represented by Mr. D. Sykes, solici-
tor, of Wentworth.
In this, case 12 or 13 witnesses were
called, and the case lasted two full
days.
After hearing the evidence and the
addresses the magistrate granted the
application.
