UNIONISTS' RIGHTS
Variation of Award Refused
Deputy-President Webb, In tho
Arbitration Court today, refused to
vary a clause In tho award of tho
Amalgamated Society of Engineers
and tho .Amalgamated Engineers'
Union.
The employers, lie said, asked the.
Court to make a variation, thb effect
of which would be to dcprlvo two
men of tho right to sue, because they
did not give the employer notice that
they were members of tlic union. The
limitation of tho . employer's liability
was put in to protect the employer,
hut tho Court did hot think fit to give
tlic employer protection beyond a cer
tain point. Tho Court protected tho
employer in respect of all future em
ployes, but not in respect of em
ployes then in their employment. -
lie did not think he would bo Justi
fied, he added, in altering that provi
sion. Ho was wholly opposed to the
employes being in u position to set up
stale claims against the employers.
He would look favorably on any rea
sonable proposal to prevent long
standing claims accruing against an
employer, who did not know tho lia
bility was being incurred. He under-
Stood other judges of the Court were
prepared to make similar awards
when asked to do so.
