Hotel Contract Case
"Most hotels in my experience do
after hours trading, ' said Mr L. B.
Cussen in the Second Civil Court, to
day. He was counsel in an action
over a hotel; lease.
"Weil they used to," remarked Mr
Justice Macfnrlan. smiling.
Mary Dalton. widow, of the Vic
torian Hotel, Elizabeth street, Mel
bourne, sued Mark Harold M-orrls,
investor, of Merton street, Iyanhoe,
for cancellation of an agreement to
buy the balance of the lease of the
Victorian Hotel; return of all money
paid under the agreement, and £1600
damages; . or. alternatively, £5000
damages. .
Mrs Dalton said the agreemcntWns
made In May, 1927, and' she was' in
duced to enter Into it by false repre
sentations made by defendant, through
his agents, McGeo and Miller. \
It wns represented to her that the
takings were at least £140 n week,
.that, there wns no after hours trad-
ang. that she would make £800 n year
profit, nnd that the compensation
payable under the Licensing Act was
£250 a year. , .
She paid £50 deposit and undertook
to pay £48 a week rent. Subsequent
ly she discovered that all of the rep
resentations were false.
Morris denied any false represen
tation. Ho alleged that Mrs Dalton
bought the lenso from another per
son, nnd he merely financed her. He
knew nothing about tho business of
the hotel.
