Sequel to Street Collision. .
An accident that happened near tho
Fawknor cemetery on tho night of
January 28 last was tho subject of an
action which tvns determined by Judge
Johnston in the County Court to-day.
Argylc rtreet, F.vwkncr, claimed £15/10/
from the defendant, John Rohorts, of
Munro street, Cohurg, as dnmngos
caused to Ids waggon and horse owing
to the alleged negligent driving of tho
defendant. .Mr J. Meagher (Instructed
by Sir Georgo Turner) appeared for tho
plaintiff. There was no appearance for
tho defendant. The plaintiff stated
hat when approaching tho Fawkner
rcmetery on January 2S, about 9.30 p.m.,
io noticed the fights of a vehicle
ihead. The lights were moving from
me side of tho road to tho other. Ho
galled out to defendant and pulled his
horse close in to the kerbstone. Tho
defendant's Jlnkcr struck his vohlclo
and broko one of the shafts, which
penetrated the side of plaintiff's horse.
Tho occupants of the Jlnker were
thrown out. Plaintiff's horse, which he
valued at £J0. died two days nftoY the
accident from tho Injuries. Defendant
Promised to call on plaintiff on the
P'gin after the .accident, but he did not
do so. Judge Johnston gave judgment
far the -plaintiff for the amount claimed,
with costs.
