NOVEL DECISION
Convicted Licensee
Fined
The rights of a hotel licensee
who appealed against a third
conviction , for illegal disposal of
liquor, arid continued to trade
pending the hearing of the ap
peal, were decided, by Mr. Ham
mond, P.M., in. the Fitzroy court
yesterday.
Keith Ernest Keillor, Mooltan-
street, Flemington, was fined £25
on three charges of .selling liquor
without a licence on April 13,
15 and 29. .
The, police case: showed' that
Keillor was convicted In Decem
ber, 1941, September, -1942, and
March, 1944, for illegal disposal
of liquor, and his licence . was
automatically ' forfeited. He ap-

missed. It was admitted -that,
pending the hearing of the ap-
Geal, defendant continued to sell
quor,, believing that-.the- lodging
of the; appeal suspended the for
feiture of the , licence.;-:
Mr. Hanimond, P.M., said by
his third conviction defendant, by
virtue of the Licensing Act, had
no licence. If he had succeeded
in his appeal, the third; convic
tion would have been expunged.
As he lost the appeal, he lost
the licence. The stay, of pro
ceedings granted did- not .nullify
the conviction.
