A MIDNIGHT ATTACK.
To-day, at the Brunswick Court, Pat-
rick Joyce was charged with having un-
lawfully assaulted Maurice Hogan on
21st December last, at Frith street.
Brunswick. Mr Shannon appeared for
complainant, and Mr F. T. Hickford
for defendant. Complainant said that
in company with Miss Elizabeth Ver-
point, he returned from Melbourne to
Brunswick by train, shortly before 12
o’clock on Saturday night, 21st Decem-
ber last. They were going to Miss Ver-
point’s residence, in Firth street, when
Joyce, who was under the influence of
liquor, came along the narrow footpath,
and deliberately bumped witness. The
defendant then made use of an offen-
sive expression. Witness took Miss
Verpoint to the gate of her home,
when Joyce came up and struck him a
violent blow. A scuffle ensued, during
which Joyce was joined by several men,
who assisted in attacking witness.
Elizabeth Verpoint gave similar evi-
dence. Witness added that she posi-
tively identified Joyce as the man who
attacked Hogan. Defendant denied
that he had laid hands on complainant.
James Walsh also gave evidence. The
bench considered that Joyce had had
something to do with the assault, and
fined him £2, in default fourteen days'
imprisonment.
