Fitzroy Murder
Retrial Begins
Allegations were made in the Criminal
Court yesterday that Raymond Murray
Baillie, 43 years, military pensioner, killed
his wife and wounded his two sons with' a
' rifle at their home in Fitzroy.
Baillie, or Nicholson-street,
North Fitzroy, has pleaded not
guilty to having murdered his
wife, Laurel Frances Baillie, on
July 23.
Baillie is being retried.
Earlier this month the first
trial ended suddenly when one
of the jurors died during the
night at the Law Courts.
The Chief Justice (Sir Ed
mund He.vring) discharged the
jury and remanded Baillie for
retrial.
Yesterday, Lance Raymond
Baillie, 20 years, driver, son
of the accused, told the court
he was awakened by an argu
ment between his parents and
went to his father's bedroom
after the argument quietened.
He said his mother put her
hand through a window and
pushed his father. Following
further argument, his mother,
brother, and he, himself, de
cided to pack and leave the
house.
Soon afterwards he heard a
shot fired and a groan. Ht
and his brother ran along a
passage, there was another
shot and his brother fell.
Witnes added that he then
attempted to shelter behind an
ice chest and a shot struck
him in the shoulder.
To Mr. R. V. Monahan, K.C.,
Witness admitted once having
threatened to kill his father
following a fight between his
father, and grandfather. Five
or six guns were kept in the
house and all the family were
brack marksmen.

William George Baillie, 18
years, carpenter's laborer, and
second son of the accused, said
he saw his father with a gun
to his shoulder and took cover
behind a chest of drawers.
During a scuffle he got the
barrel of the gun between his
legs and disarmed his father.
Soon after he realised he had
been shot in the chest.
Cross-examined by Mr. Mon
ahan, witness denied thrashing
his father with an air rifle,
breaking the weapon In course
of the beating.
The trial, which is before Sir
Edmund Herring, and a jury
of 12, will be resumed this
morning and may end late to
day.
