According to the Srmth-cfislcni i$tary " settlers
- on both sides of the border express dis
satisfaction at the exclusion of sheep iii the
present permit regulations, nnd an endeavor is
about to be made by petition to both the Sonth
Australian and Victorian Governments to
permit sheep to pass free if for bonA
fide settlers, within 20 miles of the
border. Farmers derinous of travelling their
sheep from their holdmgs on this side cf the
border - to their laud in Victoria, can under
existing regulations, only do so on depositing
6d. per head, which will be returned on their
re-crossing ; but should tliev not desire to re-
cross them, or should 'thofr'sheop die, the 6d.
per head is lost. This is looked upon as a
hardship, aud therefore the endeavor will be
made to get 'sheep included in the list of
goods andichattels that may bo poised undor
permit."
The Sydney Morning HbrcrJd of the 22nd
inot. says: — "Important judgments have
been delivered by their Honors' tho Chief
Justice, Mr. Justice Faucett and Mr. Justice
Windeyer in rc tho motion of the executors of
the will of J. Kutherford, for au order direct-
ing the Protlionotnry to issue to them probate
of the will, which had been granted
to them. The deceased had never re
sided in New South Wales, and died
domiciled iu Scotland. lie left personal
property to tho amount of £110,000, invested
iu various negotiable or other dluvttei securities
in Now South Wales. Some of this money was
secured by bills, which in their turn were col
laterally secured by mortgages to the testator
of'statious. In order to tho recovery of theso
stations to tho respective mortgagors it was
necessary for tho executors to perfect their
title by obtaining probate in this colony.
Sir William Manning, Primary Judge,
grauted probate of un exemplification . of the
will, but directed it was not to issue
until the Stamp Commissioner had been com
municated with. The Prothonotary declined
to issue it until duty had been paid on the
£110,000 under the Stamp Act of 1380. It
\vus contended on behalf of the applicant
executors that the Stum)) Act of this colony
is not a Probate Act, but a Succession or
Legacy Duty Act ; and that, as the £110,000
was personality, it followed the domicile of
the testator, and was not liable to the succes
sion of legacy duty of this colony. The court
held that the £110, OOu was subject to duty,
and dismissed tho motion with costs."
