Mistaken Identity. — A young man -
named James Hay appeared ac the Ade- -
laide police court ou Wednesday morning
charged with having used indecent lan
guage in Clarendon-street on 25th May.
I'he defendant emphatically denied the '
accusation, and said he had not been near: -
Clarendon-street for some time. Two -
constables, however, stated positively --
that he was the man who had offended.
One said that when hs was searching for
day to serve him he saw him near the
Royal Oak hotel. The defendant ran. -
through the hotel, and after leading him
a chase succeeded in getting away. Hay
here interrupted the constable, and stated
that he had never been near the Royal
Oak hotel. He asked for an adjourn
ment", as he could prove that he was
working on the date on which the alleged -
offence occurred. On Thursday morning, -
when, the case was called on, inspector '
Sullivan asked for leave to withdraw the
information, after the case for the"'
prosecution had been closed, as the police >
had discovered thai the defendant was '
the wrong man. It was a case of mistaken . '
identity, notwithstanding that two police- -
men had sworn that he was the offender,
i'he S.M. discharged the accused.
