At the local court to-ddy Thomas, Al'Cor-
muck, farmer, of Goomoora, sucd -R. A.
Onjuiis and C'o., produce merchants, of Alel-
bourne, for the recovery of ' £13 8/2, the
valutj of (14 bags of potatoes. . .
1 lie evidence for plaintiff alleged that Op
jitii August, J. Urucr, an agent for <le;
fendants, inspected and sampled plaintiff's
.potatoes, and subsequently agreed to buy
jtlicm at the rate of £3 2/G per ton; The
.potatoes reached Alelboumc by rail on 29th
August, and on the following day Jl'Cor-
mack was informed' by Oniuhs and Co. that
tho potatoes were bad and had been re
jected.
The defence, was that tho court had no
jurisdiction, inasmuch as action should
have been taken for damages in the.County
Court; that the contract- stipulated that
the potatoes were to be Carmans, whereas
such was not the case; that Gruer was not
an "agent," but a "special agent," and was
therefore personally liable to the vendor.
- A verdict, was given for plaintiff for the
amount claimed, with £0 8/ ctista,! the
chairman, Air. Barlow, P..M.. pointing out
that the contract was signet! by Grucr as
agent, and not as "special agent."
A stay of .proceedings for three weeks
was granted. '
