COURT.

Tuesday, 27th December, 1859.
DISPUTED PUOPEUTV.
A femile named M'Crae called upon Ellen
Wingrovc to show cause why sho should not re
store to her a silk dre33, valued at L2 10s, pro
perty entrusted to the respondeat, and which it
was alleged had been pawned.
The defence was, that the appellant waited upon
Sirs Wingrove, and requested her to advance a
sum of money upon a certain dress. She was
averse to do this, but undertook to release the pro
perty from the pawnshop, and pay the difference.
She accordingly gave the appellant 7s, and
paid the pawnbroker £113a fid, being interest aud
principal accruing on the property, and it was
then that the pawnbroker's ticket was handed over
to the defendant.
Verdict for the complainant, 9s Oil, and costs,
2s Gd.
DEBTOR AND CREDITOR.
A young woman named Eliza Eoote appeared in
court to call upon Ed. Oppey to show cause why
he should uot pay £5153, wages due.
The defence was that Oppey, i\\t defendant
had filed his schedule, consequently the applica
tion was beyond the jurisdiction of the Police
Court. ",
Mr FtWVi solicitor, proved the aot of insol
vency, and the applicant was referred to the In
solvent Court.
WAOES.
Charles Nott was called upon by Charles Porter
to show cause why ho should not pay £i 10s,
balance of account for work and labor done in ex
cavating a tank. ,
Win. llyatt, butcher, for whom the tank was
made, proved that ho paid Nott £6 10s on account
of work performed by Porter in excavating, the
whole expenses for which amounted to £3810s;
Porter acting under the orders and instructions
of Xott, the contractor, at the time.
The defence was that Porter had been paid in
full, inasmuch as he excavated 43 yards, which
at is per yard, amounted to L2 3s, and which
sum had been paid to him.
Case adjourned until next Friday for produc
tion of certain documents.
MAINTENANCE.
Jane Warburtori appeared before the Bench to
! compel her husband, James Warburton, to.show
i cause why he should not maintain her and her
family; also to answer the charge for having
assaulted her on Friday List, by striking her
between the eyes.
The defendant did not attend to the summonF,
and a warrant was issued for his apprehension.

The Town Inspector preferred a charge against
Richard Taylor for driving over the footpath near
the Duke of Wellington Hotel, Pakingtou-street, ?
on the 19th inst. Ordered to pay as and costs. ?
On the same day Jtr Hooker was seen by the
Town Inspector driving his van over the footpath 1
in one of the streets of the municipality. Mr 1
Hooker was fined os and costs.
