Wills and Bequests
Frederick Maitland Innes, of Collins-street, Mel-
bourne, esquire, by his will dated March 13, 1891,
and presented for probate by Messrs Blake and
Riggall, of Melbourne, solicitors, appointed the
Trustees, Executors and Agency Company, Limited,
of 37 Queen-street, Melbourne, executors. He bequeathed
to his daughters Lilian May Innes and
Isabella Violet Rosabel Innes, equally, all the jewellery,
trinkets and personal ornaments formerly
belonging to their late mother (excepting her negligee,
which, according to her desire, he bequeathed to the
said Lilian May Innes, and to his wife, Catherine
Margaret Innes, the use (so long as she remains his
widow, or so long after she re-marries as either of his .
children reside with her) of all his household furniture,
plate, linen, china, glass, books, pictures,
prints, musical instruments and other effects, and an
annuity of such an amount as together with the
yearly income of her own property shall be required
to make her net income equal to the income which
each of his children shall be entitled to, as hereafter'
mentioned, but so that such income shall under no
circumstances be less than £200 per year. The balance
of the income of his residuary estate, during
his wife's widowhood, or so long as either of his
children reside with her, he bequeathed to his
children equally. Subject to the before-mentioned
trusts, he bequeathed the whole of his residuary
estate to his children equally, sons at 21 and
daughters at that age or marriage, the income of
each daughter's share to be paid to her during her
life, and after her death her share to go to her
children, sons at 21 and daugters at that age or
marrriage. Testator died August 23, 1892, and the
will is sworn at .£10,779 personal; no real estate.
Charles Curtis, of Queenscliff, gentleman, by his
will dated August. 4,1882,; and presented for probate
by Messrs. Farmer and Turner, of Melbourne, solicitors,
appointed Frederick Kelson, of Northcote,
gentleman, and George Powell, of Warrnambool,
merchant, executors. He bequeathed ,£1000 to the
Bishop of Melbourne, to found a scholarship to be
called the " Combedown Scholarship" in Trinity
College, within the University of Melbourne; £500
to the Bishop of Melbourne, to be used for missionary
purposes in connection with the Church of
England; £100 to the "Cathedral Fund" of the
Church of England, Melbourne ; £100 to St. Mark's
Church, Fitzroy, to form an " Endowment Fund ;"
.£200 to Frederick Fuse, of Hobart ; .£100 each to
Catherine Fuse, Ellen Fuse, Frederick Fuse, the
younger, Charles Fuse and Thomas Fuse, children
of the said Frederick Fuse ; £200 to Julia Fuse,
daughter of the said Frederick Fuse, if she be unmarried
at the time of testator's death, and £100 if
she be married or a widow; £100 to Mary Ann
Bishop, daughter of Samuel Robert Bishop, of
Mitcham, Surrey, England; £100 each to Evelina
Kelson, wife of Edward Kelson, of Gore-street,
Fitzroy ; Louisa Matilda Kelson, wife of Frederick
Kelson, of Northcote, and Matilda Wood, wife of
Alfred Wood, of Warrnambool; £200 to Sarah
Maria Risby, daughter of Thomas Risby, of Collingwood,
deceased, if she be unmarried at time of
testator's death, and £100 if she be married or a
widow; £200 to Susannah Lavinia Risby, if she be
unmarried at time of testator's death, and £100 if
she be married or a widow, and a further £100 if
she be residing with testator and unmarried at testator's
death ; £50 each to the Melbourne Hospital
and the Melbourne Benevolent Asylum; £20 each to
the Hospital for Sick Children, the Homoeopathic
Hospital, the Austin Home for Incurables, the
Immigrants' Aid Society, and the Discharged
Prisoners' Aid Society, all of Melbourne; £50 to
each of his executors; and the residue of his estate
to such of the religious or charitable institutions of
Melbourne as his executors shall think fit. By a
codicil dated April 27, 1885, he bequeathed £100 to
St. George's Church, Queenscliff, to form an
"Endowment Fund." The legacies bequeathed by
his will to Susannah Lavinia Risby (since deceased)
he bequeathed to Sarah Maria Risby upon the same
conditions, in addition to the legacies already bequeathed
to her. He also bequeathed £100 to
Matilda Wood, wife of Alfred Wood, in trust for
their daughter Beatrice Risby Wood ; and £100 to
Louisa Matilda, wife of Frederick Kelson, in trust
for their children Frederick William Risby Kelson
and George Ernest Kelson, equally. He revoked the
bequests to Frederick Fuse, the younger, Charles
Fuse and Thomas Fuse, in consequence of their
alleged (testator's allegation) ill conduct to their
parents. He also revoked the condition of the
bequest to Julia Fuse, and bequeathed to her
absolutely £200. By a second codicil dated August
15, 1890, he bequeathed to Jane and Catherine,
daughters of his very old friend Smith Wallworth,
£50 each, to purchase of souvenir of testator. He
revoked the appointment of George Powell as an
executor, and appointed in his place Alfred Wood, of
Warrnambool, giving him £50 for his trouble. By
a third codicil dated March 28, 1892, he revoked the
bequest to Sarah Maria Risby, and in lieu thereof
bequeathed to her £200 and his property in
Gellibrand-street, Queenscliff, known as " Neptune
Cottage," with all furniture and effects therein.
Should there be any deficiency in his estate he
directed same to be deducted from his bequest of
.£500 for missionary purposes. Testator died October
1, 1892, and the will is sworn at £1425 real and
£3709 personal ; total, £5134.
Richard. Henry Harrington, of Warrnambool,
surgeon, by his will dated August 28, 1892, and preIsentecl'
for probate by Mr. W. Ardlie, of Warrnambool,
solicitor j appointed Andrew Norrie, of Geelong,
bank manager; Percy Whitton, of the Victoria
Water Supply Department, Melbourne, accountant;:
and Richard . Henry Harrington, of Warrnambool,
bank clerk, executors. He bequeathed all his household
furniture and effects to his wife Eliza Mackersay
Harrington absolutely, and the income of the residue
of his estate, during her widowhood. Upon her. death
or re-marriage ,he bequeathed to his sons Isadore
and Geoffrey . £200 each, and the residue to his son
Richard . Henry, and. all his .daughters equally.
Testator' died September, 25,,1892, and' the will is

Martha Amy Over, of " Nottingham Cottage;" off
Barwise-street, North Melbourne, wife of Charles
Over, of the same place, contractor, by her will dated
August 13, 1892, and presented for probate by
Messrs. Lynch, McDonald, Stillman and Keep, of
Melbourne, solicitors, appointed William Lynch, of
113 William-street, Melbourne, solicitor, executor.
She desired that her remains be interred in theBun
garee Cemetery, Ballarat, and that a monument to
cost £50 be erected over her grave. She bequeathed
to Lydia Porter, wife of William Porter, of Mainroad;
Ballarat, all her wearing apparel, jewellery,
trinkets and personal ornaments, and an annuity
of £25, and to George Watts, of Echuca, sawyer, and
William George Woodward, of Brisbane, an annuity
of £25 each. Subject to the before mentioned bequests,
and the payment of her funeral and testamentary
expenses, she bequeathed the income of her
estate to her said husband until he shall die, marry
again, or at any time reside with any member of hisown
family, and upon either of such events, she bequeathed
her residuary estate to the said Lydia
Porter, George Watts, and William George Woodward,
equally. Testatrix died October 1, 1892, and
the will is sworn at £2783 real, and £100 personal;
total, £2,883.
Archibald Ferguson, of Spring Plains, farmer, by
his will dated July 7, 1892, and presented for probate
by Messrs. Crabbe, Cohen and Kirby, of'
Bendigo, solicitors, appointed his son William, and
William Begg Murdoch, of Heathcote, bank manager,
executors. He bequeathed to his daughter
Jane, wife of John Andrew, £400; to his daughterEmily,
£500 and his piano, riding pony and saddle,
and to his wife Agnes, the use of his homestead, comprising
306 aores, and his farm, known as " Taylor's "
(80 aores.) After his wife's death he bequeathed the
said properties to his son Alexander Archibald. To
his son William, he bequeathed 45 acres of land, and
to his son Samuel the farms known as " Dawson's"
(55 acres), and "McDonald's" (20 acres.) The residue
of his personal property he bequeathed to his.
wife and two daughters. Testator died August 30,
1892, and the will is sworn at £1,197 real and £1,423personal
; total, £2,620.
Charles Fisher, of McKoan-street, North Fitzroy,,
coachmaker, by his will dated July 13, 1888, and.
presented for probate by Messrs. Crisp and Cameron,,
of Melbourne, solicitors, appointed his sister Emily
Maria Smith, wife of Alfred Smith, of McKoan-street,
North Fitzroy, brassfounder, executrix. He bequeathed
to his sister Mary Jayne, of Liverpool,.
England, widow, £100; to his sister-in-law, Mary
Fisher, of MoKean-street, North Fitzroy, widow, a.
life interest in his freehold property in Aberdeenroad,
Praliran, and subject to same he bequeathed!
the residue of his estate to his said sister Emily
Maria Smith. Testator died September 7, 1892, and
the will is sivorn at £2008 real and £125 personal s;

John Rogers, of Brighton, plumber, by his will,
dated July 9,: 1891, and presented for probate by
Messrs. Abbott, Eales and Beckett, of Melbourne,,
solicitors, appointed his daughters, Helen Allan*
Rogers and Margaret Biggnr Rogers, exeoutrices,,
and bequeathed to them the whole of his estate.
Testator died August 19, 1892, and the will is sworn*
at £2028 real and £115 personal; total, £2143. • '
•'Jame's. Oliver Davoren, of North, Fitzroy, hotelkeeper;
by his will dated May 7, 1892, and presented
for probate by Mr, E, E. Dillon, of Melbourne, solicitor,
appointed John Francis Davoren, of North
Fitzroy boot salesman, executor. He bequeathed,
the whole of his estate to his mother, Margaret
Davoren. Testator died August 25, 1892, and the
will is sworn at £800 real and £1300 personal] total,.

dated September' 20, 1890, and presented for probateby
Messrs. Salter and Finkerton, of Ballarat,
