THE POSTMASTER-GENERAL
AND THE SUPREME COURT.
A Constitutional Question.

SYDNxY, Thursday.
Kas Honor Mr. Justice Foster, sitting in
Equity this morning, delivered judgment in
connection with the application for the con
tinuanco of an injunction granted in conese
quence of the action of the Postmaster.

paper called the 1Dead Bird. It will be
remembered that in. consequence of the
recent conviction in the police court of the
publisher of the paper in question, on the
ground that the paper was an obscene
publication, the Postmaster.General decided
net to allow the paper to- pass through the
post, and notified the publisher of this
determination. The latter had entered an
appeal against the deeision of the magistrate,
and as this was pending an interim iojunec.
tion, ordering that the paper should be
transmitted was applied for, and was obtained.
Copies of the paper in questiou were sub
sequently posted, but were not delivered,
and the secretary of the post-oflice notified
that the Minister did not intend to allow the
paper to go through the post. The matter
then came before the court on an application
that an order of distraint be issued against
the Postmaster-Geneeal, and that plaintiff
might be awarded damages found to be'due
on an account being taken. On thispoint
his Honor Mr. Justice Fosts? gave his
decision this morning. After having re
viewed the arguments and allidavits,
His Honor, in a long judgmeent, refuopd
the continuation of the injonction, with costs,
a-sit was obtained - by withholding material
facts, which, if known, would have pro
vented its being granted even temporarily.
