tact with hardened criminals. The punish-
ment inflicted should be disgraceful but not
demoralising, and he trusted that what he
conceived to be the obvious remedy would
be placed in the hands of the magistrates.
Mr. C. J. Ham, Mayor of Melbourne, said
that if "larrikinism" meant assaults on the
person he would support the proposal on the
lash, but if it only meant offences against
property he would recommend the giving of
power to magistrates to regulate the dietary
scale. Offenders could be effectually punish-
ed through their stomachs, and a few weeks
on bread and water would produce a wonder-
ful result. Visiting justices had under the
Gaol Statute power to punish by altering the
dietary scale, and he saw no reason why that
power should not be extended to magistrates.
Mr. Call, P. M., said he held very strong
views on larrikinism. He would not sanction
the flogging of boys if he could find another
remedy. First of all he would strike out
the option of a fine for larrikins. The press
made a mistake in thinking that justices
could do that. They had no discretion, but
were compelled by law to prescribe a fine for
what was termed " insulting behaviour."
They could fine and imprison in default of
payment, but could not imprison without
giving the option [of] a fine. If the offenders
could pay their fine, they did so and smiled
at the Bench ; if not they boasted that they
would do the imprisonment standing on their
heads. Whipping he personally disapproved
of---that was until they had seen that they
could not suppress larrikinism in another
way. From his large experience of the gaols,
he was of opinion that much could be done
by solitary confinement and a dietary scale of
bread and water. If one sentence of that
kind did not subdue a boy, he would give
him another dose of the same treatment, but
with increased severity. Ordinary magis-
trates were just as able to regulate the dietary
scale as visiting justices, and if they had the
power of doing so conferred upon them, they
would be able to do much good. If 30 days
of solitary confinement did not subdue an
offender then he (Mr. Call) would not object
to whipping, because he would then regard
the offender as incorrigible, but, as he had
already said he would not flog unless it could
Mr. H. Cheswick, of Hawthorn, observed
that he saw one most important point that
had not been touched on yet, and that was
that boys should not be sent to gaol at all.
In this colony we had a somewhat loose state
of society, and the result was that in a great
many cases parents did not govern their
children as they ought to do. Often had he
said to the father of a badly-conducted boy,
" Why don't you give him a whipping and
put him on bread and water for a day?" but
the reply invariably was, " Oh, I could not
do that ; he is not a bad boy." He felt pity
for boys whom he had to send to gaol for
small offences when fines were not paid, and
he was satisfied that it would be a wise plan
to give them a birching in the back-yard of
a police court, and to send them out to their
companions in the street fresh from their
punishment. This would be far better than
sending them to gaol. He would not,
however, give unpaid justices the power of
birching, but would confine it to stipendiary
magistrates. One reason why we had so
much larrikinism here was that we had no
army into which young men of wild character
and loose habits could go and get reformed.
Youths of the Kelly type would make ex-
cellent soldiers, and he thought the colony
should be made a recruiting ground for the
Imperial army. They had to grapple with
the subject at once, for the crime of larrikin-
ism was positively rendering society unhappy.
Mr. A. T. Best remarked that what they
had more immediately to deal with was not
mere "larking" in the streets but ruffianism
and brutality. (Hear, hear.) The lawless
conduct he referred to was coming to a fear-
ful pass, and would eventually, unless check-
ed, end in the lynch-lawism they had in
California.
The Chairman said that in 1881 there
were 862 cases dealt with at the Fitzroy
Police Court, of which 161 were cases of in-
sulting behaviour, 21 of assaulting the police,
and 300 of drunkenness. Fitzroy was not
