    Philpot v. Ebbott.
—The plaintiff in this case was the owner of a smithy at Long Gully; he let the shop and tools to defendant for 8s. per week, for two year's. After the defendant had been in possession of the ahop for some time; platiff visited , his shop and found that part, of the building had been, taken away, and put on Ebbott's land. Philpot remonstrated against this conduct, but Ebbott said he had a right to do so; the damage alleged to have been done to the rest of the building, and value of materials removed, was £20. The defence was that defendant' had taken the premises from a previous tenant, who had erected an addition to Philpot's shop. Defendant bought these newly-added premises from the old tenant for £30; he had only re- moved these, and no damage iiad been done to Philpot's shop. No notice was given to Philpot of the sale between his first tenant and Ebbott. His Honor gave a verdict for the defendant, saying the weight of evidence was against the plaintiff. Costs allowed defendant £6 Is.
