Developed by the Family Court of Australia and the Federal Magistrates Court of Australia, the principles provide a checklist of considerations for judicial officers, legal professionals, and litigants involved in parenting disputes that involve allegations of family violence. Sections include definitions of family violence, the statutory framework, legislative requirements, family and other expert reports, interim hearings, framing interim orders, matters to consider regarding children, consent orders, and time standards for court events. This 3rd edition has been published to incorporate changes made by the Family Law Legislation Amendment (Family Violence and Other Measures) Act 2011.
Original version published in March 2009 as 'Best practice principles for use in parenting disputes when family abuse is alleged'. Revised ed. published July 2011.
