SERGEANT-MAIJOR W. T. Yesterdav Mr. and Mrs Thos, Jar rott, of Myrrhee, received the pain Major William Thomas Jarrott had been killed in action in France on 9th June. The information was con veyed to the parents by Mr. Towns end, of St. Columb 's Hall, who met Mr. and Mrs Jarrott on the arrival of the Whitfield train at Wangaratta, Sgt. Major Jarrott was 21 years of age, a native of Moyhu, and eldest son. He enlisted in January, 1916, at that time being on the staff of the State School, Wangaratta. He was educated at the Wangaratta Ag ricultural High School. He left Aus tralia on 3rd June, 1916, with the 37th Battalion. He trained at Sey nour, and went through the N.C. of Corporal. He next entered a school for N.C.O's at Port Mel bourne, and rose to the rank of ried that rank. He went through se veral training schools in England and also the musketry school at Hayling Island. He landed in France on 23rd November, and went into action a few days later. He fought at Armen tiers and also in other big pushes. He was slightly wounded in the face on one occasion, but did not leave the lines. While on the field he was raised to the rank of Sergeant-Major. Since he left Australia he has cor of the letters were published in '"The received word on 27th June that from him. While in Wangaratta he took an in ed football with local teams. He was manner made him popular with his knew him. A brother, Pte, J.M. Jarrott, enlisted at the same time, and is still fighting in France. Bro Albert E. Reginald J., Algernon V., and Aubery F. Jarrott, and his sis ters are Annie Myrtle, Martha L., and Edith A. M. Jarrott, all of whom lived at Myrrhee. The sym pathy of the people of the district will go out to Mr. and Mrs Jar rott in their loss of a devoted son; but they have the satisfaction of knowing that he did his duty brave ly and honourably. PURCHASE OF CHAFF. Judgment was given yesterday by the Full Court (Mr. Justice Gissen, Mr. Justice Schutt, and Mr. Justice McArthur), on an appeal in a case chase of chaff. Coughlan Brothers, of Wagga (N.S.W.), arranged to buy from Mrs. Martha Jar rott, of Myrhee, near Wangaratta, 50 tons of prime oaten chaff. It was to be delivered into trucks at Moyhu railway station, and none was to be cut from damaged hay. A member of the firm looked at some of the chaff forwarded under the contract at Moyhu on July 15, when the weather had been rainy. He terminated the contract on the ground that some of the chaff was wet, and some had been cut from damaged hay. He after- wards made a claim against Mrs. Jarrott for £80, the value of 100 dozen branbags supplied to hold the chaff, or for the return of the bags. A counter-claim was made by Mrs Jarrott for £226 over and above the value of the bags, for alleged breach of contract. In the County Court at Wangaratta a decision in favour of Coughlan Brothers, both on the claim and the counter claim, was given by Judge Woinarski. The ground of this judgment was that Mrs. Jarrott had broken the contract by supplying some chaff which had been cut from damaged hay. There followed an appeal by Mrs. Jarrott to the Full Court, on which judgement was given yesterday. Mr. Justice Cussen said that the Court thought that it was the duty of the buyers to arrange for the trucks to be at Moyhu station, or at ment. They had never, it appeared done any- thing towards that, and the matter became of great importance. As a result of the trucks not reaching Moyhu, some of the chaff became wet. supplying better chaff in the balance of delivery, Coughlan Brothers were not justified in repudiat- ing the contract on what was seen at the sta- tion. Apparently that aspect of the case had not been directly considered by Judge Woinarski. As things were, the Full Court was disposed to order a new trial of the action on the claim and counter-claim, but if the parties were willing, a summary decision would be now given. Counsel having stated that they would accept The Full Court's adjudication, Mr. Justice Cussen said that the Full Court set aside the judgment in the County Court, and directed that Mrs Jarrott should retain the bags. No order was made as to costs in either Court. Mr. Ham (instructed by Messrs. Notcutt and Purbrick, of Wangaratta) appeared for the appel- lant, Mrs. Jrrrott, and Mr. Hassett (instructed by Mr. D. J.
