An application bv th© plaintiff, Elizabeth E. Pinn. in the action of Pinn y. Meynell and Gunn, before the High Court, was disposed of today by Mr. Justice Higgins. The plaintiff sought for an injunction re

straining the defendants from producing the play called 'The Fatal Wedding,' and for an order transferring the proceedings to Perth. The affidavits of the plaintiff set out that she had written the manuscript of a book called ''The Fatal Wedding' during the. years 189S and 1899, and sent it to England to be published by Mr. Bentley. who sent it on to Macmilla-n and Co., Ltd., publishers. After some delay they returned the manuscript without publishing the book'. She had seen the defendants' melodrama, ! 'The Fatal Wedding,' played in' Perth, and in her opinion it was a : piracy of the book. Counsel for the defendants put in an affidavit by Clyde Meynell, stating that th© defendants', in 1905, purchased the rights of the play, ! 'The Fatal Wedding,' by Theodore Kremer,. and that the same had been played for many years in America. ] After hearing argument his Honor dismissed the application for an in- i junction and for the transfer of the proceedings to Perth, with fiveguineas costs.
