MR. JUSTICE BOOTHBY

At a meeting of the Central Committee, held at the | Napoleon Bonaparte, on the 17th August, it was resolved,

that the friends of constitutional freedom through out the colony, be invited to form local Committees in

their various districts, with a view to secure the imme- I diate dissolution of the House of Assembly, and the return of men who will not refuse to uphold the independence of Parliament and the validity of the laws.

The Central Committee have prepared copies of the memorial to His Excellency, adopted by the meeting held in Adelaide on the 12th inst., and will be happy to supply them to country residents willing to collect signatures.

The Committee will gladly furnish all information in their power on the subject of the present movement, and, they hereby invite suggestions and communications from the country districts.

MR. JUSTICE BOOTHBY.

At a Great Meeting of the Citizens of Adelaide, and others, held at White's Rooms on Monday, August 12 His Worship the Mayor of Adelaide in the chairthe following resolutions and memorial were carried by overwhelming majorities :

1. "That this meeting views with alarm the danger to which the property and constitutional rights of the

colonists are exposed, in consequence of the attitude ] assumed by Mr. Justice Boothby with regard to certain Acts of the Legislature of the province, and expresses its opinion that His Honor's procedure ought to have been enquired into by the House of Assembly, in terms

of Mr. Moorhouse's motion."

2. "That this meeting considers the reply of the Government to Mr. William Owen, in the House of Assembly, as altogether unsatisfactory, and calculated to produce great discontent throughout the colony, and

is further of opinion that the House of Assembly has I failed to maintain its proper dignity and independence

in relation to the present crisis."

3. "That the following memorial to the Governor be j adopted :

" To His Excellency Sir R. G. MacDonnell, K.C.B.,

Captain-General and Governor-in-Chief of the province of South Australia. The petition of the undersigned inhabitants of the province

" H ambly who with

That the Imperial Parliament has conferred on the inhabitants of this province the privilege of making laws for the peace, order, and good government thereof, through the two Houses of the Legislature, elected by the people with the concurrent sanction of His Excellency the governor, in Her Majesty's name, subject only to Her Majesty's disallowance.

"That your Excellency, in the constitutional exercise of the powers conferred upon you, has assented to the Customs Act, the Real Property Act, and other Acts, to the great advantage of Her Majesty's loyal subjects in

this province.

"That Her Majesty has been graciously pleased to signify it to be Her Royal will and pleasure that the said Acts, so assented to by your Excellency, should be left to their, operation, thereby necessarily confirming their validity in this province.

3 That His Honor Mr. Justice Boothby has, in open Court, denied the validity of the before-mentioned Acts, on the ground that your Excellency's assent was wrong-fully given to the same, and has further called in question the right of your Excellency to exercise the discre-tion vested in you by Her Majesty, in assenting to various Acts of the Legislature.

" That in every case wherein Mr. Justice Boothby's decisions have been referred to the law advisers of Her Majesty in England, such decisions have been declared to be erroneous, and the course taken by your Excellency has been upheld.

" That with reference to at least one of the Acts referred to, Mr. Justice Boothby has expressed his determination not to put a question to a Jury on the supposition that such Act had the force of law in the colony, although your Excellency's legal advisers have declared it to be perfectly valid.

"That in consequence of the position assumed by Mr. Justice Boothby, public confidence in the administration of the laws is now greatly impaired ; the validity of titles thrown into doubt ; the value of property diminished ; ruinous litigation threatened and the whole system of legislation in the province involved in confusion, contradiction, and contempt.

" That foreseeing the dangers likely to result ram such an antagonism between a Judge of the Supreme Court and the Parliament of the province, the Legislative Council did on the 10th day of July appoint a Select Committee to enquire into the judicial decisions of His

Honor, and to report upon the steps proper to be taken that His Honor was twice respectfully and courteously requested to attend and give evidence before the said Committee, and on his declining so to Jo was summoned in the usual formal manner, but that His Honor, in defiance of the law, refused to attend.

" That a similar enquiry was moved for in the House of Assembly, and that many of your memorialists, by petitions to the said House of Assembly, did express their desire that such enquiry should be instituted ; but your memorialists have heard, with regret and alarm, that the House of Assembly did, by the small majority of two votes, reject such motion for enquiry, expressing also an opinion that it might be inferred from the decisions of Mr. Justice Boothby that the Acts already referred to by your petitioners, and other Acts, had not the force of law, in this province.

" That considering the said Acts have been assented to by your Excellency, and left to their operation by Her Majesty, your Memorialists are of opinion that such a course of procedure on the part of the House of Assembly is incompatible with the dignity of the Parliament, subversive of the powers vested in your Excellency by the Queen, and inconsistent with the rights of self-government granted to the inhabitants of this province.

" That your Memorialists have, therefore, lost all confidence in the present House of Assembly as the safeguard of their liberties and laws, and humbly pray your Excellency to exercise the prerogative vested in "you and dissolve the present House of Assembly.

" And your Petitioners, as in duty bound, will ever pray."

Copies of the memorial, with ruled sheets for the reception of signatures, have been sent into the country districts, and it is specially desired that they be returned, numerously signed, as speedily as possible. Persons willing to collect signatures can obtain copies of the memorial and blank sheets for names on application to the undersigned.

McEwen has not complied with, and that a memorial shall also be presented to the Town Council, pointing out in emphatic language that Mr. McEwen insists on holding his seat against the wish of the ratepayers, and to the detriment of their interests, praying them, therefore, to attach! no consideration to the opinions of the said John McEwen on any question whatever affecting them." di
