WATKR ILLEGALLY DIVERTED.
SHEPPARTON, Tuesday - Carl Hauff and Otto
Hauff, two young blockholders on the Closer
Settlement at Shepparton, were proceeded against
by the State Rivers and Water Supply Commission
at the Police Court to-day, on charges of
having illegally diverted water from the commission's
channel on March 6. William Frederick Nevill,
the district engineer, stated that the lock
had been taken off the wheel, and the check bar
interfered with. Carl Hauff pleaded guilty, and
was fined £5. with £1/3/6 costs by Mr. R. Knight, It
P.M. The case against Otto Hauff was
dismissed. A similar charge was preferred against
Frederick William Bedwell who in conjunction
with his father (a farmer at Numurkah) owns a
property on the Benalla road, near Shepparton.
Defendant was stated to have splintered a portion
of the top of the door, which was then raised, a
stone being placed under it to keep it up, thus
allowing the water from the channel to flow freely
on to his proberty. Mr Nevill admitted that defendant
had received onlv iaout half the quantity of water he had
paid for, but the overpaid amount would be refunded.
Mr Knight remarked that Bedwell's case was worse
than the one previously heard. He thought the maximum
penalty, £5, was not heavy enough in a case like
this. Defendant was then fined £5. with $1/3/6 costs.
Mr. John Sutherland prosecuted on behalf of the Water
lCommission.
