Mr. Justice Hlggins's Retirement. |
At the outset of the Full Bench proceed- ings in the lndtHtiial Aibitiation Court yesterday the President, his Honour Mr. Justice M'Guvley, referred to the re- tirement of Mr. Justice Higgins as Piesi dent of the Commonwealth Court of In- dustrial Arbitration. " The membeis of this court," he said, "in common with all other industrial judges in Australia, are under a deep obligation to Mr.. Justice Higgins, Whose resignation tts President of the Commonwealth Court of Industrial
Arbitration has recently been announced. Wo cannot permit the occasion lo pass without paying tribute to one who has lor fourteen, years presided with such distinction over an institution Which lias played sucli au important part iu moulding the industrial destinies of Australia. Although tho
State courts are not subordinate to the Federal Court, they naturally are influ- enced by the judgments oï that court. Wo willingly -acknowledge tho assistance tho judgments of Mr. Justice Higgins have afforded us in our work. They constitute
a notable contribution tovvards the solu- tion of industrial problems, and no man has done more to rescue the lie.itrtienf; of those problems from the mero oppor-
tunism Which still characterises their I treatment in most other countries, tn his articles on a l New Pro- vince of Law and Order,' which
have nppeared ftoni time to time in the
'Harvard Law Review,' his Honour has staled in concise, manner some of tho principles Which ¡io has evolved and the rules upon which he has tided. These articles have attracted much attention in htadomie and administrative circles in
England and, elsewhere, and have led í to
